MSELECT is looking to hire a Chief Legal Officer for a major construction client in Erbil. Candidates must have a minimum of 5 years of relevant experience. Fluency in English, Kurdish and Arabic is a must.

Duties and Responsibilities

  • Responsible for damage caused to the company during execution of the duties entrusted to it, as well as dissemination of information considered as insurance and commercial secret in accordance with the legislation and internal normative documents of the Company.
  • Responsible for the protection of confidential information and the distribution to the non-relevant places.
  • Responsible for the outcome of decisions.
  • Responsible for the proper use of the deposited material and technical resources.
  • Responsible for the outcome of decisions taken under the authority.
  • Responsible for the discrepancies that are caused by non-observance of sanitary hygienic rules, occupational safety and health regulations
  • Implementation and control of legal issues of the company, solution of legal issues arising in the business activities of structural units and divisions within the framework of legislation
  • Providing a legal opinion on suspected cases.
  • Defend the company against claims against the company or claims filed by the company.
  • Check the documents required during the inspection of insurance events, make necessary adjustments, write notes.
  • Investigate the possibility of subrogation right.
  • Submit a claim for cases of subrogation upon payment of the insurance indemnity (as pretrial claim or by claiming at the court)
  • Write the inquiries and letters to the relevant body for subrogation work.
  • Follow-up the subrogation works
  • Carry out correspondence with the state authorities.
  • Control the changes and the additions to the corporate documents.
  • In accordance with the request of the relevant unit, to prepare the rental agreements on the real estate (representative office), documents on changes or termination of this agreements, and to submit to the relevant unit for the approval.
  • If necessary, assist in the writing and pursuit of complaints on behalf of the insured / insurer to eliminate the insurance indemnity payable under the direction or agreement of the management.
  • Conduct investigations and defend in the case of fraudulent allegations based on the direction or consent of the management, if required.
  • Give legal opinion to the incoming and outgoing contracts, documents.
  • Carry the negotiations in regard with the client’s complaint in case of payment delay etc.
  • Solve this issue in state agencies to obtain a license for advertising company cars.
  • Establishment of legal entities, branches and representative offices, preparation of necessary documents for state registration of changes in registration data, submission to registration bodies and taking when ready
  • Participation in the preparation of protocols and resolutions of the General Meeting of Shareholders, the Board of Directors and the Management Board, registration of the protocols prepared by the department in the relevant structural division.
  • Give the legal opinion on requests and contracts developed by other structural divisions of the Company.
  • Prepare the required proposals and measures for daily departmental work
  • Representation in courts and other state bodies
  • Supervise the execution of judicial acts entered into legal force and reports to the Management
  • Periodically review the status of the enforcement proceedings and reports to the Management
  • Preparation of contractual projects, conducting legal examination of incoming documents and official inquiries
  • Sending requests for legal cases (court cases) to courts and other law enforcement agencies, legal entities;
  • Carry out the accounting and archive the company’s documents of legal significance by systemizing them.
  • Performs other tasks assigned to him/her by the Management.

Skills and Qualification

  • Hold a higher degree in Law.
  • 5 years of relevant experience
  • Fluent in English, Arabic and Kurdish
  • Have technical knowledge in: the code of administrative offences, code of civil procedure, civil code, labor law, traffic rules, insurance legislation, highly capable to analyze
